CANADA EXPRESS ENTRY

CANADA EXPRESS ENTRY

Our Best Opportunity to Live and Work In Canada

Canada Express Entry is a points-based program designed for professionals wishing to live and work in Canada. This pathway provides one of the shortest application processing time – usually 6 to 12 months.

Who is eligible?

University degree holders that have skilled work experience and are reasonably proficient in English and/or French ideally qualify.

If you qualify under the programs below, you may apply for Express Entry:

  • Federal Skilled Worker (FSW),
  • Federal Skilled Trades (FST),
  • Canadian Experience Class (CEC)

Application process

Applicants start by submitting an Expression of Interest. This involves submitting their profiles in an online Express Entry pool that assigns them a score based on 1200 points.

Candidates are evaluated based mainly on their age, level of education, language skills, and Canadian or other work experience. A comprehensive ranking system (CRS) tool is used to score your profile.

If your profile is selected from the Express Entry pool, the Canadian government issues you an Invitation to Apply (ITA) for permanent residence.

PROVINCIAL NOMINATION PROGRAM

Your fastest pathway to Canadian permanent residence.

PNPs are immigration programs, are operated independently by each of Canada’s thirteen provinces and territories.

Canada’s Provincial Nominee Program [PNP] offers immigrants a valuable pathway to Canada PR Visa. The PNP permits territories and provinces in Canada participating in the PNP to nominate persons that are inclined to migrate to Canada and settle in that specific province/territory.

Each of the provinces and territories taking part in the PNP have at least one immigration stream linked with the federal Express Entry System.

Being nominated by a province or territory gets you additional 600 CRS [Comprehensive Ranking System] points.

Nominations made by provinces and territories under streams linked with EE are also referred to as “enhanced nominations”. All of the enhanced nominations are processed online. In 80% of the cases, standard processing time for such enhanced nominations is 6-months or less.

How does PNP work?

The PNP application process involves two steps.

  1. The applicant is nominated by the province they wish to settle in.
  2. If successful in the first step they submit their application for permanent residence (PR) to the federal government for approval.

How do I become eligible?

Every candidate must have their profile assessed using the province’s specific eligibility requirements.

Your application must be submitted in the province or territory where you intend to settle.

There are two routes to getting permanent residence using PNP:

  1. Express entry
  • Some PNPs expect the candidate to have an Express Entry profile for their application to be successful.
  • This greatly improves your chances of receiving an invitation to apply (ITA) for permanent residence from the federal government.
  1. Paper-based federal application

If your provincial nomination doesn’t conform to Express Entry requirements you must submit a paper-based application for permanent residence to the federal government a process which can take considerably longer than the Express Entry route.

WORK PERMIT VISA CANADA

Most employment opportunities in Canada require foreign nationals to have a work permit unless you belong to a special job category like athletes, performing artists, clergy, or member of a film crew – to mention a few.

There are two types of work permits you can apply for: open work permits and employer-specific work permits.

  • Openwork permits allow you to work in any location for any employer in Canada for the period stated in the permit.
  • Employer-specific permits limit you to work for one specific employer in one location while in Canada.

How do I become eligible for a temporary work permit in Canada?

In most instances you must first have a formal job offer to be eligible for a Canadian work permit, and the job offer must be supported by a positive Labour Market Impact Assessment (LMIA). Otherwise it must be exempt from the need to have an LMIA.

It is the responsibility of an employer wishing to hire a foreign worker to apply for a Labour Market Impact Assessment (LMIA)  from Employment and Social Development Canada (ESDC).

A positive LMIA proves that a foreign worker is needed to fill the job and that there are no Canadian workers or permanent residents available to do the job.

Note: the province of Quebec has an independent process for validating a job offer for foreign workers.

When applying for a work permit a foreign worker needs:

  1. a job offer letter
  2. a contract stipulating the terms of employment
  3. a copy of the LMIA accompanied by the LMIA number.

Additionally, temporary workers must fulfill the following requirements:

  • Prove that they plan to leave Canada once their work permit expires.
  • Prove they have sufficient funds to sustain them and their family while in Canada, as well as funds to return home.
  • Have a police clearance certificate.
  • Prove they do not pose a threat to Canada’s security.
  • Be in good health – including results of a medical exam where necessary.
  • Work for an employer who is eligible.
  • Possess the necessary documents to enter Canada.

How long is a work permit valid for?

All work permits issued to foreign workers in Canada have an expiry date.  If you wish to work in Canada on a permanent basis or for an indefinite period of time, you must become a permanent resident.

The Canadian government also limits the accumulated length of time that foreigners can work in Canada. A foreign worker may not work in Canada for a period of more than 48 months or four years. This rule applies whether you have worked consecutively over this period, or with gaps in between permits.

Once a foreign worker has accumulated 4 years of work they must leave Canada and stay out of the country for no less than 48 months or four years before qualifying to work in Canada again.

Under what circumstance is a foreign worker exempt from LMIA?

  • Foreigners who apply for an Open Work Permit in Canada do not require a job offer letter or a positive Labour Market Impact Assessment (LMIA) to support their application.
  • Open Work Permits may be applied for by:
  • Spouses or common-law partners of temporary foreign workers
  • Spouses or common-law partners of foreign students studying full-time;
  • a dependent related to someone who applied for permanent residence
  • International students recently graduated from a designated Canadian learning institution
  • A destitute student
  • Someone who has applied for permanent residence in Canada
  • SASKATCHEWAN IMMIGRATE NOMINEE PROGRAM (SINP ) APPLICATION

    SINP OFFERS APPLICATIONS:

The Government of Saskatchewan makes the final choice on SINP nominations. When successful candidates apply for permanent resident status with IRCC, they will be identify as SINP nominees
